If you do not agree with any part of these terms, you must discontinue use of our website and services immediately. These terms constitute a legally binding agreement between you and Excellence Perfumes LLC, a company registered and operating in the United Arab Emirates.

Use of Website

You may use our website for lawful purposes only and in accordance with these terms. You agree not to use the website in any way that could damage, disable, overburden, or impair our servers or networks. You must not attempt to gain unauthorised access to any part of the website, its systems, or any connected servers. Reproducing, distributing, or commercially exploiting any content from our website without our prior written consent is strictly prohibited.

We reserve the right to restrict or terminate your access to the website at any time, without notice, if we reasonably believe you have violated any provision of these terms.

Products and Pricing

All products displayed on our website are subject to availability. We make every effort to display accurate descriptions, images, and pricing of our fragrances. However, we do not guarantee that the colours, sizes, or representations displayed on your screen will be perfectly accurate due to variations in monitor settings and digital photography. A slight variation in fragrance perception is also natural and does not constitute a defect.

Prices are listed in UAE Dirhams (AED) and are inclusive of applicable VAT at the current rate of 5%. We reserve the right to change prices at any time without prior notice. The price applicable to your order will be the price confirmed at the time of purchase. Promotional discounts and offers are subject to specific terms and may not be combined with other offers unless explicitly stated.

Orders and Acceptance

Placing an order on our website constitutes an offer to purchase. All orders are subject to acceptance by Excellence Perfumes. We reserve the right to refuse or cancel any order for any reason, including but not limited to product unavailability, pricing errors, suspected fraud, or any information that we believe to be inaccurate or incomplete. If your order is cancelled after payment has been processed, a full refund will be issued to your original method of payment within the timeframe outlined in our Returns Policy.

Payment

We accept the following payment methods: Visa, Mastercard, American Express, Apple Pay, Google Pay, Tabby, Tamara, and cash on delivery (COD) within the UAE. All online payments are processed through secure, PCI-DSS compliant payment gateways. You represent and warrant that you are authorised to use the payment method provided and that all information supplied during checkout is accurate and complete.

For orders using buy-now-pay-later services such as Tabby or Tamara, the terms and conditions of the respective service provider apply in addition to these terms. Failure to meet instalment payments is a matter between you and the service provider and does not affect your obligations to Excellence Perfumes.

Shipping and Delivery

We offer delivery across the UAE and to select international destinations. Standard delivery within the UAE typically takes 2 to 4 business days from the date of dispatch. Express and same-day delivery options are available for orders placed before 12:00 PM within Dubai. International shipping times vary by destination and carrier, generally ranging from 5 to 14 business days.

Delivery times are estimates and are not guaranteed. We are not liable for any delays caused by couriers, customs clearance, weather conditions, or other factors beyond our control. Risk of loss and title for items purchased pass to you upon delivery of the items to the courier. For international orders, the recipient is responsible for any customs duties, import taxes, or additional charges levied by the destination country.

Returns and Refunds

Returns and refunds are governed by our Returns Policy, which forms an integral part of these terms. By placing an order, you acknowledge that you have read and agree to the conditions outlined in that policy, including the 14-day return window, the requirement that products remain unopened and sealed, and the categories of non-returnable items.

Intellectual Property

All content on this website, including but not limited to text, graphics, logos, icons, images, fragrance names, descriptions, packaging designs, and software, is the exclusive property of Excellence Perfumes LLC or its licensors and is protected by UAE and international intellectual property laws. The Excellence name, logo, and all related brand identifiers are registered trademarks. You may not use, reproduce, distribute, modify, or create derivative works from any content on this website without our express written permission.

Fragrance Authenticity Guarantee

Excellence Perfumes guarantees that every product sold on our website and in our boutiques is 100% authentic. We source all ingredients and finished products directly from certified suppliers and renowned fragrance houses. Any product found to be inauthentic will be eligible for a full refund along with additional compensation as permitted under UAE consumer protection laws. We actively pursue legal action against any party involved in the sale or distribution of counterfeit products bearing our name or branding.

Bespoke and Custom Orders

Customers who commission bespoke or custom-blended fragrances agree that the final product is non-returnable and non-refundable once the blending process has commenced. A 50% deposit is required at the time of order confirmation, with the remaining balance due upon completion. We will provide detailed consultation notes and scent profiles for your approval before the final blending. If the bespoke order is cancelled before blending begins, the deposit will be refunded minus a consultation fee of AED 200.

User-Generated Content

By submitting reviews, comments, photos, or any other content to our website or social media channels, you grant Excellence Perfumes a non-exclusive, royalty-free, perpetual, and worldwide licence to use, reproduce, modify, and display such content in connection with our marketing, advertising, and promotional activities. You represent that you own or control the rights to any content you submit and that such content does not infringe upon the rights of any third party.

Limitation of Liability

To the fullest extent permitted by UAE law, Excellence Perfumes shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our website or products, including but not limited to loss of profits, data, goodwill, or other intangible losses. Our total liability for any claim arising from or related to these terms or your use of the website shall not exceed the amount you paid to Excellence Perfumes for the specific product or service giving rise to the claim.

Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, or for fraud or fraudulent misrepresentation.

Indemnification

You agree to indemnify, defend, and hold harmless Excellence Perfumes LLC, its directors, employees, partners, and agents from and against any claims, damages, losses, liabilities, costs, and expenses arising from your use of the website, your violation of these terms, or your infringement of any third-party rights. This indemnification obligation will survive the termination of your use of the website.

In such events, we will make reasonable efforts to fulfil your order as soon as practicable or provide a full refund.

Governing Law and Dispute Resolution

These terms shall be governed by and construed in accordance with the laws of the United Arab Emirates, specifically the federal laws applicable in the Emirate of Dubai. Any disputes arising from or relating to these terms or your use of our website shall first be attempted to be resolved through amicable negotiation. If a resolution cannot be reached within 30 days, the dispute shall be referred to the exclusive jurisdiction of the Dubai Courts or the Dubai International Financial Centre (DIFC) Courts, at our sole discretion.

Waiver and Severability

The failure of Excellence Perfumes to enforce any right or provision of these terms shall not constitute a waiver of that right or provision. If any provision of these terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving the original intent.
